SPONSORS: The American Rivers and Bogle Vineyards Cleanup Contest (the “Contest”) is sponsored by Bogle Vineyards Inc., 49762 Hamilton Road, Clarksburg, CA 95612 and American Rivers, 1101 14th Street NW, Suite 1400 Washington, DC 20005 (the “Sponsors”).

ELIGIBILITY/WHO MAY WIN:  This Contest is open only to adult permanent legal residents of 51 United States (including D.C., excluding Puerto Rico and any state where the Contest is prohibited by law) (the “Territory”), who are 21 years of age or older and follow the instructions below (“Entrants”).  Alcohol beverage industry members, including retailers, and their families, employees, shareholders, officers, directors, agents, representatives of Sponsors, or the promotion and advertising agencies of any aforementioned entity, and their immediate family members and those living in their household, and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible.

DATES:  The Contest is monthly, with a new chance to win the prize each month. Below are the “Start Date” and “End Date” for every month (each a “Contest Period”). Entries must be received after 12:00 AM UTC  on the Start Date and by 11:59 PM UTC  on the End Date of every Contest Period.

  • April Contest Period: April 1, 2021 (“Start Date”) and ends on April 25, 2021 (“End Date”)
  • May Contest Period: May 1, 2021 (“Start Date”) and ends on May 25, 2021 (“End Date”)
  • June Contest Period: June 1, 2021 (“Start Date”) and ends on June 25, 2021 (“End Date”)
  • July Contest Period: July 1, 2021 (“Start Date”) and ends on July 25, 2021 (“End Date”)
  • August Contest Period: August 1, 2021 (“Start Date”) and ends on August 25, 2021 (“End Date”)
  • September Contest Period: September 1, 2021 (“Start Date”) and ends on September 25, 2021 (“End Date”)
  • October Contest Period: October 1, 2021 (“Start Date”) and ends on October 25, 2021 (“End Date”)
  • November Contest Period: November 1, 2021 (“Start Date”) and ends on November 25, 2021 (“End Date”)
  • December Contest Period: December 1, 2021 (“Start Date”) and ends on December 25, 2021 (“End Date”)
  • January Contest Period: January 1, 2022 (“Start Date”) and ends on January 25, 2022 (“End Date”)
  • February Contest Period: February 1, 2022 (“Start Date”) and ends on February 25, 2022 (“End Date”)
  • March Contest Period: March 1, 2022 (“Start Date) and ends on March 25, 2022 (“End Date”)

PRIZE:  Sponsors are awarding a prize package each month during the Contest for a total of twelve (12) prizes, donated by Bogle Vineyards and American Rivers. Each prize package (“Prize”) contains the following items:

  • Osprey® backpack
  • American Rivers-branded Nite Ize® waterproof pouch
  • American Rivers-branded Klean Kanteen® water bottle
  • American Rivers t-shirt
  • American Rivers National River Cleanup trash bags, gloves, safety guidance and litter clean-up instructions

Alcohol is not included as part of the Prize.

HOW TO ENTER:  To enter the Contest, follow these steps:

  1. Download the free Litterati app on your mobile device from the Apple App Store or from Google Play. Litterati LLC, is a data science company that uses technology to develop to identify, map and collect litter around the world (“Litterati”).
  2. In the Litterati app, join the Contest using the challenge code BOGLE.
  3. Claim your account and connect your account to your email to accept Litterati terms of use and to save your progress.
  4. Collect as much litter as you can during the Contest Period using Litterati to take a picture of each item and tag the type of trash it is. Whoever picks up the most pieces of litter as documented in the Litterati app and is ranked #1 on the challenge’s leaderboard when the contest period ends each month will be considered for the Prize as set forth below in the Selection Process.

PRIZE VALUE:  Each Prize has a value of approximately $160, which cannot be exchanged for cash.

SELECTION PROCESS AND PRIZE TERMS OF AGREEMENT:  Entrants will be chosen from those who follow the steps in the “How to Enter” section detailed above. The winner will be determined monthly by the automated leaderboard through Litterati, identifying the Entrant who picked up the most pieces of litter and is ranked #1 on the challenge’s leaderboard for each monthly Contest Period (“Winner”). Winner will be contacted by Litterati and instructed to contact American Rivers to claim the Prize.

Winner can only receive the Prize one time. Winner must be 21 years of age. Winner is responsible for any taxes related to this Contest.  In addition to applicable federal laws, Winner is subject to all applicable state laws, regulations, and codes in their place of residence within the United States.  If, for any reason, the Contest is not capable of completion as planned, Sponsors reserve the right to cancel, terminate, modify or suspend the Contest, including substituting the Prize.

If a Winner does not contact American Rivers by email or phone within 7 days following notification by Litterati, or is otherwise ineligible, Sponsors may proceed to selecting the Entrant who is ranked #2 on the challenge’s leaderboard by the close of each month.  If an Entrant is ranked #1 on the challenge’s leaderboard, but was named Winner in a previous month, the Winner will be the Entrant who is ranked #2 on the challenge’s leaderboard by the close of each month. If the Entrant who is ranked #2 has already received the prize in a previous month, the Winner will be the next eligible Entrant in the ranking. If neither the #1 or #2 ranked Entrants reply by email or phone within 7 days of notification by Litterati, Sponsors may choose to name a Winner from the next ranked Entrant or to not award a Prize for that month.

NOTIFICATION AND DELIVERY OF PRIZE:  An email notification from Litterati within 2 days after each Contest End Date.  Winner will be required to provide full contact information for American Rivers to notify Bogle Vineyards who will deliver the Prize.  Delivery will be transmitted via USPS, UPS mail, or FedEx.

PRIVACY POLICY: All personal information collected by Sponsors or Litterati will be used for administration of the Contest. In addition, Entrants may receive email correspondence from, or on behalf of Sponsors, subject to the privacy policy of each. Sponsors use reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and Entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. GENERAL RULES/CONDITIONS: Contest is subject to these Official Rules. By participating, Entrants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsors which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, Winners agree to release Sponsors, including its parent, subsidiary and affiliated entities together with the respective directors, employees, officers, licensees, licensors and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest, (collectively, the “Releases”) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Sponsors reserve the right to cancel or suspend the Contest, in its sole discretion, due to circumstances beyond its control, including natural disasters, pandemic, or cancellation of events. Sponsors may, in their sole discretion, cancel, modify or suspend the Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsors’ control, corrupt the administration, security or proper play of the Contest.

Sponsors may prohibit an Entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines such Entrant is attempting to undermine the legitimate operation of the Contest by cheating, plagiarizing, engaging in any deception, or any other unfair playing practices of intending to annoy, abuse, threaten, undermine or harass any other players or Sponsors’ representatives. Disputes regarding these Official Rules and/or this Contest will be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

PUBLICITY: Sponsors reserve the right to use all Winners of the Contest for publicity purposes prior to or after the Contest end date, in any media, and to use the name, likeness, hometown name, of any Entrant, including all or part of their submission, in whole or in part, for publicity purposes throughout the world, without any compensation or prior review unless specifically prohibited by law.  Each Winner will be required, as a condition of accepting a prize, to sign a declaration of eligibility, liability, and publicity release, allowing Sponsors to use the name, likeness, hometown name, submission, and winning testimonial and/or prize information of Winner as part of that publicity throughout the world, without any compensation or prior review unless specifically prohibited by law.

DISPUTES: To the fullest extent permitted by law, Entrants agree that: (1) Any and all disputes, claims and causes of action brought by him/her arising out of or connected with this Contest or a prize awarded (collectively, “Dispute”) shall be resolved individually, without resort to any form of class action; (2) Any and all Disputes shall be settled in an amicable discussion between the Entrant and Sponsors. If any Dispute cannot be resolved in such manner, before resorting to any other legal remedy, entrant and Sponsor shall be determined solely by arbitration in Yolo County, California before one JAMS arbitrator agreed upon by the parties.  The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.  Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction; (3) Any and all claims, judgments, and awards to Entrant shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; (4) Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
